Optional Damage Waiver

This Damage Waiver (“Waiver”) is offered as an optional add-on to your Equipment Rental Agreement with EquipMe LLC (“EquipMe”). The Waiver reduces your financial exposure for accidental damage to rented equipment in exchange for a daily fee. The Waiver is not insurance and does not replace any insurance you carry.
1. Election
At booking, you may Accept or Decline the Damage Waiver. Your election is recorded with your booking and applies for the full rental term.
2. Waiver Fee
The Damage Waiver fee is 10% of the daily rental rate, charged per rental day. The fee is non-refundable and is payable with the rental fee.
3. Coverage — Waiver Accepted
3.1 Covered events. The Waiver caps your liability for accidental physical damage to the equipment occurring during permitted use to a deductible of $500 per rental.
3.2 Exclusions. The Waiver does NOT cover and you remain fully liable for:
- Intentional damage or vandalism
- Damage resulting from gross negligence or willful misconduct
- Damage caused by operation while impaired by alcohol, drugs, or medication
- Damage caused by unauthorized operators (operators not legally qualified for the equipment class)
- Damage caused by use outside the agreed-upon geographic area or use other than the permitted use described at booking
- Theft without a police report filed within 24 hours of discovery and provided to EquipMe
- Damage occurring while the equipment is sublet, subleased, or transferred to a third party
- Loss of accessories, attachments, or original components not returned with the equipment
- Cleaning fees, fluid replacement, and routine wear
- Damage occurring during loading, unloading, or transport by Lessee or third parties not engaged by EquipMe
- Mechanical failure not caused by Lessee
4. Coverage — Waiver Declined
If you decline the Damage Waiver, you bear full financial responsibility for any damage, loss, or theft of the equipment during the rental term, including repair costs, replacement costs at fair market value, downtime / loss-of-use charges, and reasonable third-party assessment fees.
5. Coordination With Your Insurance
The Damage Waiver is not insurance. If you carry insurance covering rented equipment, your insurance is primary. The Waiver, if elected, applies after your insurance has been exhausted or denied, subject to the deductible in Section 3.1. You remain responsible for cooperating with insurance claims and providing documentation.
6. Filing a Damage Report
Damage must be reported to (702) 710-5095 or equipmellc@gmail.com within 24 hours of occurrence (or, if discovered at return, immediately at return). Photos, witness statements, and police reports (where applicable) must be provided within 5 business days. Failure to report timely may void Waiver coverage.
7. Acknowledgment
By accepting this Waiver, you acknowledge that (a) you have read and understood the coverage and exclusions; (b) the Waiver is optional and not required to rent equipment; (c) the Waiver is not insurance; (d) you may decline and bear full liability instead.
