Rental Terms & Conditions

These Rental Terms & Conditions ("Terms") govern the rental of heavy equipment from EquipMe Rentals ("we", "us", or "EquipMe") to the renter ("you" or "Renter") identified on the booking confirmation. By confirming a booking, paying a deposit, or taking possession of any equipment, you agree to these Terms.

1. Rental Agreement

Each booking confirmation, invoice, and pickup/delivery record forms part of the rental agreement between you and EquipMe Rentals. The equipment, dates, rates, jobsite, and payment terms specified at checkout are incorporated by reference into these Terms.

2. Dry Hire Only

EquipMe Rentals rents equipment on a "dry hire" basis only — equipment is provided without an operator. The Renter is solely responsible for ensuring that any operator using the equipment is qualified, trained, licensed where required, and physically capable of safe operation. EquipMe Rentals does not provide certified operators, training, or supervision as part of any rental.

3. Term, Pickup, and Return

The rental term begins when equipment is picked up or delivered to your jobsite and ends when the equipment is returned in the same condition (normal wear excepted) to the location designated by EquipMe Rentals. Late returns are billed at the prevailing daily rate for each additional day or partial day until the equipment is recovered.

4. Payment Terms

Full payment is collected at booking via secure third-party payment processor. EquipMe Rentals does not store payment card data. Additional charges (extension days, fuel, damage, late return, cleaning) may be billed after return. All amounts are in U.S. dollars.

5. Damage Waiver and Insurance

Optional damage waiver may be added at checkout at the rate disclosed. The damage waiver reduces the Renter's responsibility for accidental damage but does not cover loss, theft, vandalism, willful misuse, operator negligence, overloading, off-road damage outside manufacturer specifications, or damage occurring while equipment is operated by an unqualified person.

<<BRAD_DECIDE: Certificate of Insurance (COI) requirement>> — Default conservative position: the Renter must maintain general liability and equipment-specific coverage of not less than $1,000,000 per occurrence naming EquipMe Rentals as additional insured, and shall furnish a COI on request. Confirm whether to require COI for all rentals, only above a certain rental value, or only for specific equipment classes.

6. Renter Responsibilities

The Renter agrees to: (a) inspect the equipment at pickup and at return; (b) operate the equipment only within manufacturer specifications and applicable law; (c) prevent use by unauthorized, unqualified, or impaired persons; (d) keep the equipment at the jobsite address provided at booking and not sublet, lease, or relocate the equipment without prior written consent; (e) provide secure overnight storage; and (f) report damage, loss, theft, or accidents to EquipMe Rentals within 24 hours.

7. Prohibited Use

Equipment may not be used: outside the State of Nevada without prior written consent; for any unlawful purpose; in violation of OSHA, manufacturer, or local jurisdiction requirements; while operator is impaired by alcohol, drugs, or fatigue; for racing, competition, or any use the equipment was not designed for.

8. Risk of Loss; Damage Charges

The Renter bears risk of loss for the equipment from pickup through return. Damage beyond normal wear is billed at repair cost plus downtime at the daily rental rate until the equipment is repaired. Total loss is billed at fair market replacement value.

9. Liability and Limitation of Damages

<<BRAD_DECIDE: Liability cap>> — Default conservative position: To the maximum extent permitted by Nevada law, EquipMe Rentals's aggregate liability arising out of any rental shall not exceed the total amounts paid by the Renter for that rental. EquipMe Rentals shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, project delay, or third-party claims, even if advised of the possibility of such damages. Confirm whether to keep cap at "amounts paid for the rental," raise to a fixed figure, or reference insurance limits.

10. Indemnification

The Renter shall defend, indemnify, and hold harmless EquipMe Rentals, its owner, employees, and contractors from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to the Renter's use, operation, or possession of the equipment, including any third-party injury or property damage.

11. Delivery and Pickup

Delivery is offered for an additional flat fee disclosed at checkout. The Renter is responsible for ensuring jobsite access, sufficient room for equipment offload, and the presence of an authorized representative to accept delivery. Wait time and re-delivery may be billed at our standard rates if the jobsite is not ready.

12. Cancellation

Cancellations more than 48 hours before scheduled pickup are refunded in full less a $50 administrative fee. Cancellations within 48 hours of pickup forfeit the first day of rental. Once equipment has been picked up or delivered, cancellation is not available.

13. Default

The Renter is in default if: payment fails or is reversed; equipment is not returned by the agreed return date and an extension is not approved; the equipment is operated outside the terms of this agreement; or any representation made at booking is materially false. EquipMe Rentals may recover the equipment, suspend further rentals, and pursue all available remedies.

14. Governing Law and Venue

<<BRAD_DECIDE: Governing law and dispute venue>> — Default: These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or any rental shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, and the parties consent to personal jurisdiction and venue in those courts. Confirm whether to keep litigation venue (Clark County, NV) or substitute mandatory binding arbitration (e.g., AAA Construction Rules, seat in Clark County, NV) with class-action waiver.

15. Severability; Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the booking confirmation and any signed inspection or delivery records, constitute the entire agreement between the parties and supersede all prior or contemporaneous communications.

16. Updates

EquipMe Rentals may update these Terms from time to time. The version in effect on the date of booking governs that rental. Future rentals are governed by the version in effect at the time of the new booking.
