Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the equipment rental services provided by EquipMe LLC (“EquipMe,” “we,” “us,” or “our”) through https://equipme.rentals and any related services (collectively, the “Services”).

1. Acceptance of Terms

By accessing the Services, creating an account, requesting a quote, or renting equipment, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in Nevada. For equipment requiring a driver's license (e.g., towed trailers), you must hold a valid, unexpired driver's license appropriate to the equipment class.

3. Services Description

EquipMe Rentals operates an equipment rental platform serving Las Vegas, Nevada and surrounding areas. The Services include browsing equipment availability, requesting quotes, booking rentals, electronic execution of rental documents, payment processing via Stripe, and delivery / pickup coordination.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify us immediately at equipmellc@gmail.com of any unauthorized use.

5. Equipment Rental Terms

Each rental is governed by the Rental Agreement executed at booking, the Damage Waiver (if elected), and these Terms. Delivery and return windows are confirmed at booking. Equipment must be returned in the condition received, accounting for normal wear.

Late returns: Equipment returned after the agreed return time incurs a late fee of $50/hour or 1.5× the daily rate prorated, whichever is greater, capped at 2× the daily rate. Late returns also extend the renter's liability for damage and loss.

6. Payment Terms

Payment is processed through Stripe, Inc. By submitting payment, you authorize EquipMe Rentals to charge the payment method provided. Deposits are held against damage and loss and are released within 5 business days after equipment return and inspection, less any deductions itemized in writing.

Cancellation policy: Full refund if canceled 48 or more hours before scheduled rental start; 50% refund if canceled 24–48 hours before; no refund if canceled within 24 hours of rental start; full refund if equipment is unavailable or materially not as described.

7. Prohibited Uses

You may not (a) use equipment for any unlawful purpose; (b) operate equipment while impaired; (c) sublease, transfer, or permit unauthorized use; (d) modify, disassemble, or remove identification from equipment; (e) operate equipment outside the agreed-upon geographic area without prior written consent; (f) use the Services to harass, defraud, or harm any party.

8. Insurance Requirements

For rentals requiring insurance, renters must maintain minimum $1,000,000 general liability coverage plus proof of equipment coverage for items valued over $5,000, and provide a Certificate of Insurance naming EquipMe LLC as additional insured prior to delivery, where applicable.

9. Limitation of Liability

To the maximum extent permitted by Nevada law, EquipMe Rentals's aggregate liability arising out of or related to the Services or any rental shall not exceed the total fees paid by you to EquipMe Rentals for the rental giving rise to the claim. EquipMe Rentals is not liable for indirect, incidental, consequential, special, or punitive damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless EquipMe Rentals, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from (a) your use of the Services or rented equipment; (b) your breach of these Terms or any Rental Agreement; (c) your violation of applicable law; (d) damage, loss, or theft of equipment in your possession.

11. Governing Law and Disclosures

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Disclosures required under NRS Chapter 482 and NRS Chapter 597 are incorporated by reference and provided at the time of rental where required.

12. Dispute Resolution

You agree to attempt to resolve disputes informally by contacting equipmellc@gmail.com before initiating formal proceedings. Any dispute not resolved informally within 60 days shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with arbitration seated in Clark County, Nevada. For any dispute not subject to arbitration, exclusive venue lies in the state or federal courts located in Clark County, Nevada. You and EquipMe Rentals agree to bring claims only in your individual capacity and not as part of any class or representative action.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Modification

EquipMe Rentals may modify these Terms at any time by posting an updated version. Material changes will be communicated via email to active account holders. Continued use after the effective date of changes constitutes acceptance.
